1. Agreement to these terms
These Terms of Use ("Terms") are a binding agreement between you and AIVolve LLC, an Illinois limited liability company ("AIVolve," "we," "us," or "our"), which operates VibeCoderSOS at vibecodersos.com. They govern your use of the website and all VibeCoderSOS services (the "Services").
By using the Services, submitting a form, connecting a repository, or making a purchase, you agree to these Terms and to our Privacy Policy. If you use the Services on behalf of a company, you confirm that you have authority to bind it, and "you" includes that company. You must be at least 18 years old.
2. The Services
VibeCoderSOS helps people who built apps with AI tools (such as Lovable, Bolt, Replit, v0, Cursor and Claude Code) get those apps into production on accounts they own. The Services may include:
- Free X-ray: an automated analysis of your app, from a read-only GitHub connection, a zip upload, a pasted
package.json, or our local command-line tool. It identifies your stack, hosting options and likely costs, the accounts and keys your app depends on, and potential launch and security issues. - Paid outcomes: fixed-price packages delivered by AIVolve developers with the help of AI agents. Examples include taking your app live on accounts you own with your domain; migrating your app off a builder platform subscription; fixing specific security issues; and producing an Owner's Manual and developer handoff document.
- SOS developer sessions: live, time-boxed sessions with an AIVolve developer.
- Maintenance plans: recurring monthly support, monitoring and fixes within the plan's scope.
For each paid outcome, the specific deliverables, the definition of "done" (the "Done Criteria"), price, estimated delivery time and anything excluded will be stated on the product page, at checkout, or in a written scope we send you (the "Scope"). If the Scope conflicts with these Terms, the Scope controls for that order.
X-ray reports and AI-assisted outputs are informational. They may be incomplete or wrong, and they are not a security audit, penetration test, or legal or compliance advice. We may change, add or discontinue features of the free Services at any time.
3. Your account
You may need to give us an email address or create an account to use some Services. Keep your information accurate and your login secure. You're responsible for activity under your account, and you should tell us promptly at support@aivolve.com if you suspect unauthorized use.
4. Your code and intellectual property
- You own your stuff. As between you and us, you keep all rights in your code, app, content, data and accounts ("Your Materials").
- Limited license to us. You grant AIVolve a limited, non-exclusive, non-transferable, revocable license to access, copy, analyze, modify and deploy Your Materials only as needed to provide the Services you requested. That includes processing by the service providers listed in our Privacy Policy. This license ends when the Services end, subject to the retention periods in our Privacy Policy.
- Deliverables are yours. Once you have paid in full, you own the code changes, configuration and documents we create specifically for you (including your Owner's Manual and handoff doc) ("Deliverables").
- Our tools stay ours. AIVolve keeps all rights in the VibeCoderSOS website, X-ray engine, CLI, agents, templates, checklists and know-how ("Our Materials"). If any of Our Materials are included in a Deliverable, you get a perpetual, royalty-free license to use them as part of that Deliverable. Open-source components remain under their own licenses.
- No training, no publishing. We do not use Your Materials to train AI models, and we will not publish them or a case study about your app without your written permission.
- Feedback. If you send us suggestions, we may use them without obligation to you.
5. Third-party accounts and costs
- In your name. We deliver outcomes on accounts that you own and control, such as hosting (for example Netlify, Railway or Vercel), databases (for example Supabase), domain registrars, payment processors, email services and AI providers. You are responsible for creating those accounts (we'll guide you), accepting their terms, and keeping them in good standing.
- You pay providers directly. Hosting, domain, database, API usage and other third-party fees are your responsibility. They are not included in our price unless the Scope says so. Any cost estimates we give are good-faith estimates, not guarantees.
- Leaving a builder platform. Before you cancel a subscription with a builder platform (for example Lovable, Bolt or Replit), confirm with us that your migration is complete and that you have exported everything you need. Some platform features, such as built-in databases, authentication, hosting or AI credits, may not transfer or may need to be replaced. We'll flag these in your Scope.
- Referral links. We may recommend providers we have referral or affiliate relationships with (for example Netlify, Railway or Namecheap), and they may pay us a commission. You're free to choose any provider.
6. Orders, payment and pre-orders
- Prices. Prices are fixed per outcome and shown at checkout or in your Scope, in U.S. dollars, plus any applicable taxes.
- Payment processors. Payments are processed by Lemon Squeezy, which acts as merchant of record for purchases made through it (so its buyer terms also apply and it may appear on your statement), or by Stripe. Unless your Scope says otherwise, payment is due in full when you order.
- Maintenance plans renew automatically each month until you cancel. You can cancel at any time, and cancellation takes effect at the end of the current billing period.
- Pre-orders. If you pre-order a Service before it is generally available, you'll receive the Service at the pre-order price when it launches. You can request a full refund of a pre-order at any time. If we don't make the Service available within 90 days of your pre-order, we'll refund you automatically on request.
7. Outcome guarantee and refunds
We sell outcomes, not hours. Our guarantee is simple: if we can't deliver the outcome defined in your Done Criteria, you get your money back. Specifically:
- Before work starts. If, after reviewing your app, we decide we can't deliver the outcome, we'll tell you and refund 100% of the outcome fee. You may also cancel for a full refund at any time before we begin work.
- If we can't finish. If we don't meet the Done Criteria within 14 days after you have completed your responsibilities in Section 9 (or a longer period stated in the Scope), you may choose to (a) let us keep working at no extra charge, or (b) receive a refund of 100% of the outcome fee for that order.
- Acceptance. When we believe the Done Criteria are met, we'll show you. You have 7 days to tell us, in writing, of any way the delivery doesn't meet them. We'll fix those gaps, and if we can't, item 2 applies. If you don't respond within that time, or once you start using the delivery in production, the outcome is accepted.
- SOS sessions. You can reschedule or cancel for a full refund up to 24 hours before the session. If our developer misses the session, you'll get a full refund or a free rebooking, whichever you prefer. Sessions are sold as time-boxed help and don't come with a guaranteed fix.
- Maintenance. Monthly fees are non-refundable for periods that have already started, except where the law requires otherwise, or where we fail to provide the plan's services in a given month, in which case we'll refund or credit that month.
The guarantee doesn't apply when the failure is caused by: you not providing needed access, accounts, information or decisions within 14 days of our request; changes you or others make to your code or accounts during the project; outages, policy changes, rejections or limits imposed by third-party providers (for example a payment processor declining your business); work outside the Scope; or your request to change the Scope after work begins (which we may quote separately). Third-party fees you paid to providers are not refundable by us.
To request a refund, email support@aivolve.com with your order details. We'll process approved refunds through the original payment method within 10 business days. Purchases made through Lemon Squeezy are refunded by Lemon Squeezy on our instruction. This section doesn't limit any non-waivable rights you have under consumer protection law.
8. Security and scope limits
We'll fix the security issues listed in your Scope using reasonable professional care. However:
- No software is perfectly secure. We do not guarantee that your app is free of vulnerabilities, bugs, data loss or downtime, or that it complies with any particular law or standard (such as GDPR, HIPAA, PCI DSS or SOC 2), unless the Scope expressly says so.
- An X-ray or review covers only the code and configuration we were given at that time, and only the checks we describe. Issues outside that scope, in third-party services, or introduced later are not covered.
- You remain responsible for your app, how it handles your users' data, and your own legal obligations as its operator.
9. Your responsibilities
- Backups. Keep complete backups of your code, database and content before and during our work. We take reasonable care, but we are not responsible for data loss if you didn't keep a backup.
- Credentials. Grant the least access needed, preferably by inviting us as a collaborator rather than sharing passwords. Rotate any keys or passwords you shared with us once the project ends, and remove our access when you no longer need it.
- Cooperation. Provide timely access, information and decisions, and review and approve changes when we ask.
- Rights and lawful content. You confirm that you own or have the right to share Your Materials with us, and that your app, its content, and its handling of personal data comply with the law and the terms of the platforms you use.
- Your users. You are responsible for your app's own privacy policy and terms, and for any notices or consents your users need, including for personal data we may encounter while working on your app.
10. Confidentiality and NDA for paid work
Every paid engagement is covered by a non-disclosure commitment. For all paid outcomes, SOS developer sessions and maintenance plans, this section is a binding non-disclosure agreement between you and AIVolve. You don't need to sign anything extra for it to apply.
- What's protected: your source code, app data, databases, credentials (passwords, API keys, tokens and access you grant), and any non-public business information you share with us ("Confidential Information").
- Who is bound: AIVolve LLC and all of its employees, developers and contractors who work on your project. Each of them is bound by written confidentiality obligations at least as protective as these.
- How we use it: only to deliver the Services you bought. We disclose it only to AIVolve personnel and contractors who need it for your project, and to the service providers listed in our Privacy Policy as needed to process it. We never sell, publish or reuse it for other customers, and we never use it to train AI models.
- How long: these obligations last for 3 years after the Services end. For your source code and credentials, they last indefinitely.
- Exceptions: information that is or becomes public through no fault of ours, that we already lawfully knew or independently developed, or that we receive lawfully from someone else without a duty of confidentiality. If the law requires us to disclose something, we'll tell you first where the law allows, and disclose only what is required.
- Return and deletion: when the engagement ends, we remove our access to your accounts and delete your Confidential Information according to the retention periods in our Privacy Policy, or sooner if you ask.
- Countersigned NDA: if you'd like a signed copy of this NDA, or want us to sign your own NDA, email support@aivolve.com and we'll send one back countersigned by AIVolve.
We also keep confidential any non-public information you share during the free X-ray, under the same terms.
11. Acceptable use
You agree not to use the Services to:
- submit code or content you don't have the right to share, or that infringes anyone's intellectual property or privacy;
- build, deploy or maintain malware, phishing, spam, fraud, unlawful surveillance, or anything illegal or that violates a third-party platform's terms;
- process data that requires special handling (such as protected health information or full payment card data) without telling us in writing first and agreeing on the terms;
- probe, attack, overload or reverse engineer the Services, bypass usage limits, or scrape them;
- resell the Services or use them to build a competing product without our written permission.
We may decline or stop work, or suspend access, if we reasonably believe a request breaks these rules.
12. Third-party platforms; no affiliation
VibeCoderSOS and AIVolve are independent. We are not affiliated with, endorsed by, or sponsored by Lovable, Bolt (StackBlitz), Replit, v0 or Vercel, Cursor (Anysphere), Netlify, Railway, Supabase, GitHub, Namecheap, Anthropic or any other platform we mention. Their names and marks belong to their owners and are used only to describe compatibility.
AIVolve LLC is a Claude Certified Services Partner in Anthropic's partner program. That status belongs to AIVolve LLC. It does not mean Anthropic endorses, reviews, or is responsible for VibeCoderSOS or any work we do for you.
Third-party services are governed by their own terms, and we're not responsible for their availability, pricing, changes, security or actions.
13. Disclaimer of warranties
We will perform paid Services in a professional manner consistent with generally accepted industry practice. Except for that commitment and the guarantee in Section 7, the Services, X-ray reports, AI-generated outputs and Deliverables are provided "as is" and "as available." To the fullest extent the law allows, AIVolve disclaims all other warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the Services or your app will be uninterrupted, error-free or secure. Some jurisdictions don't allow certain disclaimers, so some of these may not apply to you.
14. Limitation of liability
To the fullest extent the law allows:
- AIVolve's total liability for all claims arising out of or relating to the Services or these Terms is limited to the amount you paid AIVolve for the Services giving rise to the claim in the 12 months before the event that caused it. If you used only free Services, the limit is US $100.
- AIVolve is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or business interruption, even if we were told they were possible.
These limits don't apply to liability that can't be limited by law, such as fraud or gross negligence where applicable, and they apply even if a limited remedy fails of its essential purpose.
15. Indemnity
You agree to defend, indemnify and hold harmless AIVolve and its members, employees and contractors from third-party claims, losses and reasonable costs (including legal fees) arising from: Your Materials; your app and how you operate it, including your handling of your users' data; your violation of these Terms or the law; or your use of third-party accounts. We'll promptly notify you of any claim and let you control the defense, but you may not settle a claim that imposes obligations on us without our consent.
16. Suspension and termination
- You may stop using the Services at any time, cancel a maintenance plan as described in Section 6, and revoke our access to your repositories and accounts.
- We may suspend or terminate your access if you materially breach these Terms (including the Acceptable Use rules), fail to pay, or if continuing would expose us or others to legal or security risk. If we terminate a paid order for reasons that aren't your fault, we'll refund any fees for work not yet delivered.
- When the Services end, we will remove our access, delete your materials according to our Privacy Policy, and hand over any completed Deliverables you've paid for.
- Sections 4 (ownership), 7 (refunds already due), 10, and 13–19 survive termination.
17. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Will County, Illinois, and both parties consent to their jurisdiction.
Before filing a claim, please email support@aivolve.com so we can try to resolve it informally. Either party may seek injunctive relief in court to protect confidential information or intellectual property. Nothing in this section removes mandatory consumer rights you have in your country of residence.
18. General
These Terms, the Privacy Policy and any Scope make up the entire agreement between us about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. We are independent contractors.
19. Changes to these terms
We may update these Terms from time to time. We'll post the new version here with an updated date, and for material changes we'll notify customers by email or on the site at least 14 days before they take effect. Changes don't apply retroactively to orders already placed. Continuing to use the Services after changes take effect means you accept them.
